Terms of Service

Short version

PopcornCue helps you track shows and movies; it is not a streaming service. You remain responsible for your library, imports, and backups. Catalog metadata, availability, and release schedules can change or be incorrect. The app is distributed through Apple, and third-party services remain subject to their own terms.

1. Who Provides PopcornCue

PopcornCue ("PopcornCue," "the app," "Service," "we," "our," or "us") is provided by KD incubator UG (Haftungsbeschränkt), Schonensche Str. 13, 10439 Berlin, Germany. These Terms of Service ("Terms") govern your use of the app and this website.

2. Acceptance of These Terms

By downloading, accessing, or using PopcornCue, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the app or website. If you use PopcornCue for another person or organization, you confirm that you have authority to accept these Terms for them.

3. What PopcornCue Does

Depending on the version available to you, PopcornCue may let you:

  • follow shows and maintain movie watchlists;
  • track episodes, watched titles, rewatches, and viewing progress;
  • view upcoming episodes and schedule local reminders;
  • search and discover shows, movies, cast, and characters;
  • create collections and review personal viewing insights;
  • rate titles and add reactions, watch methods, and favorites; and
  • import supported viewing history from a compatible archive.

We may add, change, limit, suspend, or remove features over time. Features may require a compatible Apple device, a supported iOS version, internet access, device permissions, or access to a third-party service.

4. Eligibility

You may use PopcornCue only if you can legally enter into these Terms and comply with applicable law. PopcornCue is not intended for children under 13. If you are under the age of majority where you live, use the app only with consent and supervision from a parent or legal guardian.

5. Your Data and Responsibilities

You are responsible for the accuracy, legality, and backup of information you add or import. Review your library, watched state, ratings, schedule, reminders, imports, and settings before relying on them. You are also responsible for protecting your device, Apple ID, passcode, backups, and archive files.

You retain ownership of information you add. You grant us only the limited rights needed to provide, maintain, secure, troubleshoot, and improve PopcornCue as described in the Privacy Policy.

6. Acceptable Use

You agree not to:

  • use PopcornCue for illegal, harmful, or abusive purposes;
  • interfere with the app, website, servers, or security controls;
  • scrape, overload, probe, or access the service through unauthorized automated means;
  • copy, modify, reverse engineer, or create derivative works except where applicable law expressly permits it;
  • remove copyright, trademark, or proprietary notices;
  • resell, rent, sublicense, or commercially exploit the Service;
  • use PopcornCue in a way that violates Apple's rules; or
  • submit feedback, files, screenshots, or other material you do not have the right to provide.

7. Catalog Data and Release Information

PopcornCue is a tracking and discovery tool, not a streaming service. It does not provide access to episodes, movies, or subscription video services. Title metadata, images, cast information, availability, networks, release dates, times, countdowns, and recommendations come from third-party sources or calculations based on that data.

This information can be incomplete, delayed, changed, region-dependent, or wrong. A listing does not guarantee that a title will air, release, or be available at the shown time or through a particular provider. Verify important availability directly with the broadcaster, distributor, or streaming provider.

8. Imports

PopcornCue may import supported data from files exported by third-party services such as TV Time. Import compatibility is provided for convenience and may change if a third party changes its export format. Imports can contain duplicates, missing records, mismatches, or unsupported fields, so review the result before relying on it and keep an independent copy of important source files.

PopcornCue is not affiliated with, endorsed by, or sponsored by TV Time. Third-party names and trademarks belong to their respective owners.

9. Ratings, Feedback, and Submissions

If you submit ratings, reactions, watch methods, favorites, product feedback, bug reports, roadmap votes, screenshots, or other material, you confirm that you have the right to submit it. You grant us a worldwide, non-exclusive, royalty-free license to host, process, reproduce, adapt, aggregate, and use it as reasonably necessary to operate, secure, support, and improve PopcornCue.

Do not submit unlawful, confidential, infringing, malicious, or abusive content. We may remove, disregard, or restrict submissions and related access when reasonably necessary to enforce these Terms, protect the Service, or comply with law.

10. App Store and Purchases

If you download PopcornCue from the Apple App Store, you also agree to Apple's applicable terms. These Terms are between you and us, not Apple. Apple is not responsible for PopcornCue, its content, maintenance, support, warranties, or claims except as required by law or Apple's own terms.

If paid features, trials, subscriptions, or in-app purchases are offered, the price, duration, and included features will be shown in the App Store or app. Apple processes payment, renewal, cancellation, restoration, and refund requests under its policies. Deleting the app does not cancel an active subscription.

11. Intellectual Property

PopcornCue's software, interface, design, text, graphics, logo, app icon, website, and original materials are owned by us or our licensors and are protected by intellectual-property law. We grant you a limited, revocable, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes under these Terms and Apple's rules.

Posters, stills, title information, names, logos, and other third-party materials remain the property of their respective owners. Their display in PopcornCue does not transfer any ownership to you or us.

12. Third-Party Services

PopcornCue depends on third-party services for app distribution, device features, catalog data, artwork, hosting, infrastructure, support, feedback, and roadmap functionality. We are not responsible for third-party outages, data loss, policy or pricing changes, content quality, availability, or security incidents outside our control.

13. Availability, Changes, and Support

We try to keep PopcornCue useful and reliable, but do not guarantee that the app or website will always be available, secure, uninterrupted, error-free, compatible with every device, or free from data loss. We may release updates, change requirements, discontinue features, or stop supporting older versions. An update may be required for continued use.

14. Warranty Disclaimer

To the maximum extent permitted by law, PopcornCue is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, or reliability.

Nothing in these Terms limits rights you may have under mandatory consumer-protection law.

15. Limitation of Liability

To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, data, or opportunity; missed releases or reminders; incorrect catalog data; import errors; device problems; or reliance on information arising from use of or inability to use PopcornCue.

Under German law, nothing in these Terms excludes or limits liability for intent, gross negligence, injury to life, body, or health, guarantees, product liability, or other liability that cannot be excluded. For simple negligence, liability is limited to breaches of material contractual obligations and foreseeable damages typical for this type of contract.

16. Indemnity

To the extent permitted by law, you agree to indemnify and hold us harmless from claims, damages, liabilities, losses, and expenses arising from your misuse of PopcornCue, violation of these Terms or law, or infringement of third-party rights.

17. Termination

You may stop using PopcornCue at any time. We may suspend or terminate access to online features, the website, or support if you violate these Terms, misuse the Service, create risk for others or us, or if we discontinue PopcornCue or a feature. App Store subscriptions, if any, must be cancelled through Apple.

18. Privacy

Our Privacy Policy explains how personal data is processed in connection with PopcornCue and forms an important part of your relationship with us.

19. Changes to These Terms

We may update these Terms when PopcornCue, legal requirements, pricing, features, providers, or business needs change. The updated Terms will be posted here with a new date. If changes are material, we will take reasonable steps to notify you. Continued use after updated Terms take effect means you accept them.

20. Governing Law and Consumer Rights

These Terms are governed by German law, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods. If you are a consumer in the European Union or another jurisdiction with mandatory consumer protections, those protections remain unaffected.

21. Dispute Resolution

If you have a concern, contact us first so we can try to resolve it informally. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board unless applicable law requires otherwise.

22. Final Provisions

If any provision is invalid or unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not assign your rights or obligations without our consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or transfer of PopcornCue or its business.
